Wyoming special education IEP compliance and timelines
Governing regulations: WDE Chapter 7 Rules (Services for Children with Disabilities); Wyo. Stat. §§ 21-2-501 et seq.. State education agency: Wyoming Department of Education.
- Initial evaluation
- Wyoming follows the federal timeline: the district has 60 calendar days from receipt of signed parental consent to complete the evaluation and determine eligibility.
- Initial IEP meeting
- A meeting to develop the IEP must be held within 30 calendar days of the eligibility determination. (34 CFR § 300.323(c)(1); WDE Chapter 7 Rules)
- Annual review
- At least once every 365 days (34 CFR § 300.324(b)(1)).
- Reevaluation
- At least every 3 years, and not more than once a year unless the parent and district agree (34 CFR § 300.303).
- Transition planning
- Must be in effect by age 16.
- Academic standards
- Wyoming Content and Performance Standards
- IEP forms & systems
- No single mandated statewide IEP software. WDE publishes model special education forms, and districts and BOCES choose their own platforms.
Where Wyoming differs from the federal baseline
- The 60 calendar day clock covers both completion of evaluations and the eligibility meeting, and runs through school breaks.
- WDE publishes model forms, including prior notice and consent for initial services, that many districts use directly.
- Written consent for the initial provision of services is separate from consent for evaluation.
- Rural districts often share evaluators and low-incidence services through BOCES.
Current monitoring priorities
- Initial evaluation timeline compliance (Indicator 11)
- Secondary transition IEP content (Indicator 13)
- Resolution of state complaints and correction of noncompliance
