Indiana special education IEP compliance and timelines
Governing regulations: 511 IAC 7 (Article 7, Special Education). State education agency: Indiana Department of Education.
- Initial evaluation
- 50 instructional days from receipt of parental consent to complete the evaluation and convene the case conference committee; a 20 instructional day timeline applies in specified cases.
- Initial IEP meeting
- The case conference committee meets within the same 50 instructional day window to determine eligibility and develop the initial IEP. (511 IAC 7-40-5; 511 IAC 7-42)
- Annual review
- At least once every 365 days (34 CFR § 300.324(b)(1)).
- Reevaluation
- At least every 3 years unless the parent and LEA agree it is unnecessary, and not more than once a year without agreement (34 CFR § 300.303).
- Transition planning
- Must be in effect by age 14, earlier than the federal age of 16.
- Academic standards
- Indiana Academic Standards
- IEP forms & systems
- Indiana IEP (IIEP), a statewide web-based IEP system, is used by most Indiana public schools.
Where Indiana differs from the federal baseline
- Indiana counts its evaluation clock in instructional days, so non-student days and breaks do not run the clock.
- IEP teams are called case conference committees under Indiana rule.
- Transition planning begins before the student enters grade 9 or turns 14, whichever comes first.
- Indiana law (IC 20-35.5) requires dyslexia screening in the early grades, separate from IDEA eligibility.
