New Jersey special education IEP compliance and timelines
Governing regulations: N.J.A.C. 6A:14 (Special Education). State education agency: New Jersey Department of Education.
- Initial evaluation
- New Jersey runs one combined clock: evaluation, eligibility determination and, for eligible students, development and implementation of the IEP must be completed within 90 calendar days of receipt of parental consent for the initial evaluation.
- Initial IEP meeting
- The initial IEP must be developed and implemented within the same 90-day window that starts at receipt of consent for evaluation, so there is no separate 30-day clock running after eligibility. (N.J.A.C. 6A:14-3.4; N.J.A.C. 6A:14-3.7)
- Annual review
- At least annually (N.J.A.C. 6A:14-3.7; 34 CFR § 300.324(b)(1)).
- Reevaluation
- At least every 3 years, or sooner if conditions warrant or the parent or teacher requests (N.J.A.C. 6A:14-3.8).
- Transition planning
- Must be in effect by age 14, earlier than the federal age of 16.
- Academic standards
- New Jersey Student Learning Standards
- IEP forms & systems
- No single statewide IEP system. Districts and their child study teams use vendor IEP platforms and must produce IEPs that meet N.J.A.C. 6A:14-3.7 content requirements.
Where New Jersey differs from the federal baseline
- After a written referral, the district must hold an identification meeting within 20 calendar days (excluding school holidays but not summer vacation) to decide whether an evaluation is warranted (N.J.A.C. 6A:14-3.3).
- The 90-day window covers evaluation through IEP implementation, which is stricter in practice than the federal 60 days plus 30 days.
- Transition planning begins with the IEP in effect when the student turns 14, two years earlier than the federal baseline (N.J.A.C. 6A:14-3.7).
- Evaluations and eligibility decisions are made by the child study team (school psychologist, learning disabilities teacher-consultant and school social worker) together with the parent.
- Written notice of a proposed action must be given and, absent parental consent, the action generally cannot be implemented until 15 calendar days after notice (N.J.A.C. 6A:14-2.3).
Current monitoring priorities
- Compliance with the 90-day consent-to-implementation timeline (Indicator 11)
- Placement in the least restrictive environment
- Secondary transition IEP content beginning at age 14 (Indicator 13)
