Utah special education IEP compliance and timelines

Governing regulations: USBE Special Education Rules, incorporated by Utah Admin. Code R277-750; Utah Code Title 53E, Chapter 7, Part 2. State education agency: Utah State Board of Education.

Initial evaluation
The initial evaluation and eligibility determination must be completed within 45 school days of the LEA receiving signed parental consent. The 45 school day timeline applies to initial evaluations, not reevaluations.
Initial IEP meeting
A meeting to develop the IEP must be held within 30 calendar days of the eligibility determination. (USBE Special Education Rules (R277-750); 34 CFR § 300.323(c)(1))
Annual review
At least once every 365 days (34 CFR § 300.324(b)(1)).
Reevaluation
At least every 3 years, and not more than once a year unless the parent and LEA agree (34 CFR § 300.303).
Transition planning
Must be in effect by age 16.
Academic standards
Utah Core Standards
IEP forms & systems
No single mandated statewide IEP software. USBE publishes model compliance forms, including prior written notice and consent forms, and LEAs choose their own IEP platforms.

Where Utah differs from the federal baseline

  • Initial evaluations run on a 45 school day clock from receipt of consent, not the federal 60 calendar days.
  • Consent for evaluation is not consent for the provision of special education services, which requires separate consent.
  • USBE publishes model compliance forms, including a combined prior written notice and consent form for evaluation, that many LEAs adopt directly.
  • Charter schools are their own LEAs in Utah and carry full evaluation and IEP responsibility.

Current monitoring priorities

  • Initial evaluation timeline compliance (Indicator 11)
  • Results-driven program improvement planning with LEAs
  • Secondary transition IEP content (Indicator 13)
