Nebraska special education IEP compliance and timelines
Governing regulations: 92 NAC 51 (Rule 51); Neb. Rev. Stat. §§ 79-1110 et seq.. State education agency: Nebraska Department of Education.
- Initial evaluation
- The initial multidisciplinary evaluation must be completed within 45 school days of the district receiving written parental consent. NDE guidance adds that the state rule cannot exceed the federal 60 calendar days, so the shorter of the two controls.
- Initial IEP meeting
- The IEP team must meet to develop the IEP within 30 calendar days of the eligibility determination, and services follow as soon as possible after the IEP is developed. (92 NAC 51-007; 34 CFR § 300.323(c)(1))
- Annual review
- At least once every 365 days (34 CFR § 300.324(b)(1); 92 NAC 51-007).
- Reevaluation
- At least every 3 years, and not more than once a year unless the parent and district agree (34 CFR § 300.303).
- Transition planning
- Must be in effect by age 14, earlier than the federal age of 16.
- Academic standards
- Nebraska College and Career Ready Standards
- IEP forms & systems
- No single mandated statewide IEP system. NDE publishes model forms, and districts and Educational Service Units choose their own IEP software.
Where Nebraska differs from the federal baseline
- Initial evaluations run on a 45 school day clock from receipt of consent, shorter than the federal default in most school calendars (92 NAC 51-009.04).
- Transition planning must appear in the IEP beginning with the first IEP after the student turns 14, two years earlier than the federal baseline.
- Parental consent for an initial evaluation is not consent for the initial provision of special education services, which requires separate written consent (92 NAC 51-009).
- Nebraska serves children with verified disabilities from birth, so Part C and Part B transition timelines are coordinated under 92 NAC 51 and 92 NAC 52.
Current monitoring priorities
- Initial evaluation timeline compliance (Indicator 11)
- Secondary transition IEP content beginning at age 14 (Indicator 13)
- Results-driven accountability for student outcomes
