Where Oklahoma differs from the federal baseline
- Initial eligibility runs on a 45 school day clock from receipt of consent, which State law sets in place of the federal 60 calendar days.
- The district has 10 school days to move from review of existing data to obtaining consent or documenting the parent's refusal.
- OSDE recognizes two narrow exceptions to the 45 school day timeline, described in its Evaluation and Eligibility Handbook.
- Students with an IEP may qualify for the Lindsey Nicole Henry Scholarship for private school tuition, which affects how districts handle IEP status and records requests.
Current monitoring priorities
- Initial evaluation timeline compliance (Indicator 11)
- Differentiated monitoring based on results indicators
- Secondary transition IEP content (Indicator 13)
